These Terms and Conditions ("Terms", "Agreement") govern Your access to and use of all mobile applications, puzzle games, translation tools, and utility software (collectively, the "Services" or "Games"), including any in-app purchases, virtual items, and subscription plans developed or published by Soon To The Moon IE ("Company", "We", "Us", or "Our").

Please read these Terms carefully before downloading, installing, or using Our Services. By accessing or using any part of the Services, You agree to be bound by these Terms and Our Privacy Policy. If You do not agree to all of these Terms, You must not access or use the Services.

1. Acceptance of Terms & Eligibility

By accessing or using Our Services, You affirm that:

You are at least 13 years of age (or the minimum legal age required in Your country to consent to digital services without parental authorization).
If You are between the ages of 13 and the legal age of majority in Your jurisdiction, You have reviewed these Terms with Your parent or legal guardian, and they agree to these Terms on Your behalf.
You possess the legal capacity to enter into a binding contract with the Company under the laws of the Republic of Armenia and Your local jurisdiction.

2. License Grant and Restrictions

Subject to Your compliance with these Terms, the Company grants You a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and access the Services on supported Apple iOS/iPadOS devices for Your personal, non-commercial entertainment and utility purposes.

Prohibited Uses: You expressly agree that You will not:

Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or derive source code from any portion of the Services.
Use automated systems, bots, scrapers, crawlers, or data-mining tools to extract data, text, artwork, or UI elements from the Services.
Use the Services or any output generated by the Services to train, fine-tune, benchmark, or develop artificial intelligence models, neural networks, or competing software products.
Rent, lease, lend, sell, redistribute, license, or commercially exploit any part of the Services or its Content.
Attempt to bypass, disable, circumvent, or disrupt any security mechanisms, digital rights management (DRM), or technical protection measures in the Services.

3. Artificial Intelligence (AI) Features & Disclaimers

Certain features of Our Services utilize integrations with advanced Third-Party Artificial Intelligence (AI) APIs and Large Language Models (LLMs) (such as Google Gemini, OpenAI, or equivalent providers) to process text translation, voice transcription, and conversational features.

On-Demand Processing: Content submitted by You (such as typed text or audio recordings) is transmitted to Third-Party AI API providers only when You explicitly initiate an AI feature (e.g., tapping a translate or speak button).
Disclaimer of AI Output Accuracy: Generative AI outputs are probabilistic and automated. The Company makes no representations or guarantees regarding the accuracy, completeness, reliability, or appropriateness of any translation, transcription, or generated response. You agree not to rely on AI-generated output for professional, legal, medical, financial, or safety-critical decisions.
No AI Model Training: The Company contractually requires that User inputs submitted via API endpoints are not retained or utilized by third-party providers to train or refine their public AI models.

4. On-Device Image Processing (OCR)

Where Our Application provides Optical Character Recognition (OCR) or camera translation tools:

Image recognition and text extraction occur 100% locally on Your physical device using on-device Machine Learning frameworks (such as ML Kit).
Camera feeds and photo gallery images are processed entirely in local device memory and are never uploaded, stored, or transmitted to external cloud servers.

5. In-App Purchases and Auto-Renewable Subscriptions

Our Services may offer virtual currency, digital goods, or recurring auto-renewable subscription plans ("In-App Purchases").

App Store Processing: All transactions, payment processing, and billing for In-App Purchases and Subscriptions are managed directly and exclusively by Apple through Apple StoreKit. The Company does not collect or store Your credit card or financial details.
Subscription Renewals: Subscriptions automatically renew at the beginning of each billing cycle unless You turn off auto-renewal at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
Subscription Management & Cancellations: You can manage, modify, or cancel Your active subscriptions at any time via Your iOS device settings (Settings > Apple ID > Subscriptions).
Refunds: All purchases are final and non-refundable, except as required by applicable law or Apple App Store policy. Refund requests must be directed to Apple Customer Support (reportaproblem.apple.com).

6. User Content & License Grant

If You submit, record, or transmit content through the Services (including translation text, voice recordings, feedback, or review comments) ("User Content"):

You retain full ownership and intellectual property rights in Your User Content.
You grant the Company a worldwide, royalty-free, non-exclusive, sublicensable license to host, process, reproduce, and display Your User Content solely as necessary to provide, deliver, and operate the Services requested by You.
You represent and warrant that Your User Content does not infringe upon any third-party copyrights, trademarks, privacy rights, or applicable laws, and does not contain illegal, defamatory, or harmful material.

7. Intellectual Property Rights

All software, code, graphics, artwork, UI/GUI designs, game mechanics, characters, animations, sound effects, audio tracks, logos, and trademarks contained within the Services (excluding User Content) are the exclusive property of Soon To The Moon IE or its licensors and are protected under international copyright, trademark, and intellectual property laws.

Feedback: Any suggestions, bug reports, or feature ideas You submit to Us regarding the Services ("Feedback") shall automatically become the exclusive property of the Company. We may use Feedback for any commercial or technical purpose without obligation, attribution, or financial compensation to You.

8. Third-Party Services and Advertisements

Our Services may contain third-party Software Development Kits (SDKs) and integration frameworks, including Google AdMob for advertisements, Google User Messaging Platform (UMP) for privacy consent management, and Unity Gaming Services for Remote Config and service initialization.

The Company does not control and is not responsible for the content, privacy policies, or practices of third-party advertisers or external websites linked within the Services.
Your interactions with third-party advertisements or external links are solely between You and the applicable third party.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOON TO THE MOON IE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT:

THE SERVICES WILL MEET YOUR REQUIREMENTS OR OPERATE IN AN UNINTERRUPTED, SECURE, OR ERROR-FREE MANNER.
DEFECTS OR ERRORS IN THE SOFTWARE OR AI OUTPUTS WILL BE CORRECTED.
THE SERVICES ARE FREE OF VIRUSES, MALWARE, OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SOON TO THE MOON IE, ITS OWNER, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, DATA, GOODWILL, WORK STOPPAGE, OR DEVICE MALFUNCTION) ARISING OUT OF OR IN CONNECTION WITH:

YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICES;
ANY AI-GENERATED OUTPUT OR TRANSLATION ERRORS;
ANY THIRD-PARTY CONDUCT OR CONTENT WITHIN THE SERVICES;
ANY UNAUTHORIZED ACCESS, ALTERATION, OR TRANSMISSION OF YOUR DATA.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE TOTAL AMOUNT PAID BY YOU TO THE COMPANY FOR THE SPECIFIC SERVICE IN QUESTION DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless Soon To The Moon IE and its officers, employees, contractors, and affiliates from and against any third-party claims, liabilities, damages, losses, costs, or expenses (including reasonable legal and attorney fees) arising out of or related to:

Your misuse of or access to the Services;
Your breach of any provision of these Terms;
Your violation of any third-party right, including copyright, trademark, or privacy rights;
Any claim that Your User Content caused damage to a third party.

12. Suspension and Termination

By You: You may terminate this agreement at any time by deleting all copies of the Services from Your devices and canceling any active subscriptions via Apple ID settings.
By Us: We reserve the right to suspend, restrict, or terminate Your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including if You breach these Terms, engage in fraudulent or abusive activities, or if We decide to discontinue offering a specific game or service.
Effect of Termination: Upon termination, Your license to access the Services immediately ceases. All provisions of these Terms which by their nature should survive termination shall survive (including ownership provisions, warranty disclaimers, indemnity, and limitations of liability).

13. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the substantive laws of the Republic of Armenia, without giving effect to any choice of law or conflict of law principles.

You agree that any legal action, suit, or judicial proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the courts of competent jurisdiction located in Yerevan, Republic of Armenia, and You hereby consent and submit to the personal jurisdiction of such courts.

14. Severability and Entire Agreement

Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of these Terms shall remain in full force and effect.
Entire Agreement: These Terms, together with Our Privacy Policy and any applicable App Store rules, constitute the entire legal agreement between You and Soon To The Moon IE regarding the Services, superseding all prior or contemporaneous communications, proposals, or understandings.

15. Changes to These Terms

We reserve the right to update or modify these Terms at any time in Our sole discretion. When We update these Terms, We will revise the "Last Updated" date at the top of this document.

Your continued use of any Service following the publication of revised Terms constitutes Your explicit agreement to and acceptance of the updated Terms. We encourage You to review these Terms periodically.
